1. Scope

These Terms and Conditions apply to all purchases made through the online store of:

(hereinafter referred to as “Alexandra Fuks”, “we”, “us” or “our”).

These Terms and Conditions govern the contractual relationship between Alexandra Fuks and customers purchasing products through our online store.

Mandatory statutory consumer rights remain unaffected.

The language available for the conclusion of the contract is English.

2. Products and Made-to-Order Production

All Alexandra Fuks corsets and corsages are made to order. Each piece is individually handcrafted after an order has been placed.

For products from our regular collection, customers select an available base size and provide the requested individual body measurements. These measurements are used to adapt the piece to the customer.

Customers are responsible for providing complete and accurate measurements and other information requested during the ordering process.

If measurements or other information provided by the customer appear incomplete, unclear or inconsistent, we may contact the customer before production begins.

Due to the handcrafted nature of our products and the use of natural materials, minor variations in leather grain, surface texture, colour and handcrafted details may occur. These natural variations are part of the individual character of each piece and do not constitute a defect, provided that the product otherwise conforms to the agreed specifications.

3. Bespoke Commissions

Our Bespoke service offers customers the opportunity to commission an individually designed corset.

Depending on the commission, elements including the silhouette, shape, colour, materials, decorative details, finishes and individual measurements may be selected or developed in consultation with the customer.

The final design, specifications, price and any other individual conditions of a Bespoke commission will be agreed with the customer before the commission is confirmed.

Due to their individual nature, Bespoke pieces are created specifically for the respective customer.

4. Product Information and Representation

We make every reasonable effort to describe and represent our products accurately.

However, colours and other visual characteristics may appear slightly different depending on the customer's device, screen settings and display configuration.

Product photographs are intended to represent the design and appearance of the respective piece as accurately as possible.

Natural leather is an individual material and may display variations in grain, texture and surface appearance.

5. Prices and Payment

The prices displayed in our online store at the time an order is placed apply to the respective purchase.

Any applicable shipping costs will be displayed during checkout before the customer submits the order.

Payment must be made using one of the payment methods offered during checkout.

For deliveries outside the European Union, customs duties, import taxes or other fees may be imposed by the authorities of the destination country.

Unless expressly stated otherwise during checkout or required by applicable law, such customs duties, import taxes and other destination-specific charges are not included in the product price or shipping price and are the responsibility of the customer.

6. Conclusion of Contract

We understand that purchasing a made-to-order piece is an important decision. Therefore, customers may request the cancellation of an order within 24 hours after the order has been placed.

If an eligible cancellation is requested within this period, the order will be cancelled and any payment already received will be refunded to the original payment method.

After the 24-hour cancellation period has expired, production of the individually made-to-order piece may begin. For this reason, cancellations can no longer be accepted after this period, except where required by applicable law.

To request a cancellation within the 24-hour period, please contact us at Contact@alexandra-fuks.de as soon as possible.

This voluntary cancellation policy does not affect any statutory rights that cannot legally be excluded.

7. Production Time

All corsets and corsages are individually handcrafted after an order is placed.

The estimated production time is generally 4–6 weeks from the point at which the order and all information required for production, including the customer's measurements where applicable, have been received.

The production time is separate from the shipping and delivery time.

Because every piece is individually handcrafted, occasional production delays may occur.

If a significant delay affects an order, we will inform the customer as soon as reasonably possible.

8. Worldwide Shipping and Delivery

We offer worldwide shipping.

Available shipping methods, shipping costs and, where applicable, estimated delivery times are displayed during checkout.

Please note that the stated production time of 4–6 weeks is separate from shipping time. Delivery times vary depending on the destination and the selected shipping service.

Customers are responsible for providing a complete and accurate delivery address.

For international deliveries, customs processing may result in additional delivery time.

For deliveries outside the European Union, customs duties, import taxes or other charges may be imposed by the destination country. Unless otherwise stated during checkout or required by applicable law, these charges are the responsibility of the customer.

For consumer purchases, the statutory provisions regarding the transfer of risk during shipment apply. Nothing in these Terms transfers the shipping risk to a consumer earlier than permitted by applicable law.

9. Personalised Products and Right of Withdrawal

Our products are made to order and may be manufactured according to individual selections and/or body measurements supplied by the customer.

Where a product is not prefabricated and its manufacture is governed by an individual choice or decision by the consumer, or where the product is clearly tailored to the consumer's personal needs, the statutory right of withdrawal may be excluded in accordance with Section 312g (2) No. 1 of the German Civil Code (BGB).

Where the statutory requirements for this exception are met, the customer therefore has no statutory right of withdrawal for the respective personalised product.

This applies in particular to products individually manufactured according to customer-specific measurements or individually agreed Bespoke specifications, provided the statutory requirements for the exclusion are fulfilled.

The exclusion of the right of withdrawal does not affect statutory rights relating to defective or incorrectly supplied products.

10. Defective, Damaged or Incorrect Products

If a product is defective, damaged or does not conform to the agreed specifications, statutory warranty and consumer rights remain unaffected.

Please provide the relevant order information and, where appropriate, photographs showing the issue.

The exclusion of a statutory right of withdrawal for qualifying personalised products does not exclude or restrict statutory rights relating to defective goods.

11. Customer Measurements

Where body measurements are required, customers must take reasonable care to provide complete and accurate measurements in accordance with the measurement instructions provided by Alexandra Fuks.

Customers are responsible for the accuracy of the measurements they submit.

To the extent permitted by applicable law, Alexandra Fuks is not responsible for fitting problems caused solely by materially inaccurate measurements supplied by the customer.

This does not affect the customer's statutory rights where a product is defective or where the product has not been manufactured in accordance with the measurements and specifications agreed with the customer.

12. Intellectual Property

Unless otherwise stated, the designs, photographs, graphics, texts, branding, logos and other original content presented on this website are owned by or licensed to Alexandra Fuks and are protected by applicable intellectual property laws.

The content of this website may not be reproduced, distributed, commercially exploited, modified or used without prior permission from Alexandra Fuks, except where such use is permitted by applicable law.

Nothing contained on this website grants any licence or right to use any trademark, design, photograph or other protected material without the prior written consent of the respective rights holder.

13. Third-Party Services and Shopify

Our online store is powered by Shopify, which provides the technical e-commerce infrastructure that enables us to offer our products and services online.

Purchases made through our store are contracts directly between the customer and Alexandra Fuks.

Certain functions of the website, including payment processing and other technical services, may be provided by third-party service providers. Their own terms and privacy provisions may apply where relevant.

14. Liability

Alexandra Fuks is liable without limitation where liability is mandatory under applicable law, including in cases of intent and gross negligence and for injury to life, body or health.

Nothing in these Terms excludes or restricts liability where such exclusion or restriction is prohibited by applicable law.

Mandatory statutory consumer rights remain unaffected.

15. Privacy

Personal data is processed in accordance with our Privacy Policy and applicable data protection legislation.

Because our online store is hosted using Shopify, certain personal data may also be processed by Shopify and other service providers required for the operation of the store, payment processing, fulfilment and related services.

16. Governing Law

These Terms and contractual relationships with Alexandra Fuks are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), insofar as legally permissible.

If the customer is a consumer and mandatory consumer protection provisions of the country in which the customer has their habitual residence provide protection that cannot legally be excluded by the choice of German law, those mandatory provisions remain unaffected.

17. Severability

If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected to the extent permitted by law.

The applicable statutory provisions shall apply in place of any invalid or unenforceable provision.

18. Changes to These Terms

We may update these Terms and Conditions where necessary, for example due to changes in our services, business processes or applicable legal requirements.

The version applicable to an individual purchase is generally the version made available to the customer at the time the respective order is placed, subject to mandatory applicable law.

19. AI-Assisted Content

Certain visual content presented on this website may be created or digitally modified with the assistance of artificial intelligence. This may include the representation or modification of models, environments, backgrounds and other elements of visual presentation.

The fashion designs and physical products presented by Alexandra Fuks are original, real creations. The use of artificial intelligence relates to their visual presentation and does not represent the creation of the physical products themselves.

Artificial intelligence may also be used as an assisting tool in the preparation or editing of written content. Published written content is reviewed and editorially controlled by Alexandra Fuks.
